Every one of your essays fills me with dread. I’m sure the majority of Americans would be horrified by a future like this, but if they don’t wake this is what they will get.
I don’t enjoy writing essays that fill people with dread. I would prefer to write something more uplifting. But the confluence of my experience speaks to this moment for Americans who care enough to save our democracy. I’m glad you’re one of them.
This thing was THIS BAD in 2022 when they first published. What's worse is that no one picked it up then, including me. And when I did finally start talking about it, very few Americans took it seriously or paid attention. That is changing. We still have time to explain these stakes. But we have to do it. The mainstream media won't. Social media won't. It's old-school postcards and door-knocking and face-to-face conversations and hard-hitting ads about the stakes that will change this election.
Is there a case pending on the SC docket for next term that will serve as a test case for voiding the Establishment clause of 1A? They've so far been expanding the scope of the Free Exercise clause by nibbling, but "root and branch" means biting off the Establishment clause in its entirety and spitting out, as they did with the 2A reference to "well regulated militia".
I occurs to me that if the GOP wins control of the govt., in January 2025, one of their first acts will be to kill the filibuster so Mike Johnson can pass a "Right to Pray" bill in the House, the Senate leader can pass it with a simple majority, and Trump can sign it. It would instantly be challenged by ACLU, I wouldn't be surprised if the SC was pretty quick to use it to nix the Establishment clause using some tortured "Originalist" BS, penned by S.A.Alito. This would basically allow "Welcome to Gilead" signs to be erected everywhere.
In my view, Biden should go ahead and use his powers to abolish the filibuster now, because you're correct. If Republicans win a Senate majority, they will do it on day 1. Or the dictator will sign an executive order outlawing the filibuster. Either way, it's gone. Day 1.
That's another thing Democrats are not making clear, because I'm not even sure most of them are clear on what's at stake yet. This isn't about Biden. This is about defeating the Republican Party at every level of government in November. We must win the House. We must win the Senate. We must hold or flip statehouses blue. WE MUST.
I think the Democrat Party's biggest problem is how disconnected it is from reality. Especially those who've been in DC a long time. Younger progressives who are calling for the Democrats to be more aggressive are right, in my view. If Biden and his administration don't do something with the gift the Supremes gave them before the election, they almost deserve to lose. We don't deserve that, though. Which is why I'll keep fighting for them and figure out what to do once we survive the election.

My musing above was an “if” statement. OF COURSE WE NEED TO PREVENT THIS!
And two DINO Senators stand between Biden and filibuster reform. He hasn’t shown much interest in doing anything to sway them, either.
